These Terms of Service (“Terms”) govern your use of HMind accounts, cloud sync, sharing, web services, subscriptions and website. The installed HMind software is also subject to the End User License Agreement. By using a connected service or creating an account, you agree to these Terms. If you do not agree, you may still use local features that do not require a connected service, subject to the EULA.

Eligibility and authority

You must be at least 13 and old enough to consent to online services where you live. If you are below the age of legal majority, a parent or guardian must review and accept these Terms for you. If you use HMind for an organization, you represent that you have authority to bind it.

HMind services

HMind is a local-first mind-mapping product for supported desktop and mobile platforms. Local creation, editing and saving do not require an account. Optional connected services include account management, cross-device sync, subscription entitlements, support and password-protected read-only sharing. Features and platform availability may change as the product develops.

Your account

Provide accurate information and keep your sign-in methods and devices secure.
Do not share credentials or allow another person to impersonate you.
Notify us promptly if you suspect compromise or unauthorized activity.
You are responsible for activity under your account unless caused by our breach of these Terms.

Local files, sync and backups

Your local .hmind file is under your control. When you enable sync, HMind maintains a connected copy and may merge revisions across devices. Sync is not a substitute for an independent backup and conflict resolution cannot guarantee that every edit will be preserved. Keep backups of important files and confirm that attachments are available before deleting their original or app-managed copies.

Your content

You retain ownership of content you create. You grant HMind a limited, non-exclusive license to host, copy, transmit, format and display connected content only as needed to provide sync, sharing, support and other features you request. This license ends when the content is deleted from active systems, subject to reasonable backup, security and legal retention.

You are responsible for having the rights to content you import, attach, sync or share. Importers may support only part of another format; review the result before relying on it.

A share link permits recipients to view the selected map as configured. Treat the link and password as access credentials. You are responsible for intended recipients and shared content. Revocation prevents future access through HMind but cannot recall information a recipient already copied, exported or captured. Do not use share links to disclose information unlawfully or without required permission.

Free and Pro

HMind may offer Free functionality and Pro features. Current capabilities are described in the app or pricing page. Entitlements are linked to the account used for purchase or restoration. We may add, improve or retire features, but will not remove a paid, time-limited entitlement before its stated term except where required for security, law or abuse prevention.

Subscriptions, billing and refunds

Plans, price, currency, tax, billing period and any trial are shown before confirmation.
Subscriptions renew automatically unless cancelled before the renewal date shown by the billing provider.
Manage or cancel through the provider that processed the purchase.
Cancellation normally stops future renewal; access continues until the end of the paid period unless the provider states otherwise.
Refunds, chargebacks, trials and payment disputes follow applicable law and the processing provider’s rules.
Loss of Pro does not remove your local files; Pro-only actions become unavailable when the entitlement ends.

Acceptable use

You must not:

Violate law, intellectual-property, privacy or other rights.
Upload malware, malicious code or content designed to disrupt a device or service.
Probe, bypass or interfere with authentication, rate limits, access controls or share protection.
Scrape, overload or access HMind through unauthorized automated means.
Use HMind to harass, exploit, defraud, impersonate or endanger another person.
Resell or provide the connected service to third parties unless we agree in writing.

Feedback

If you submit ideas or product feedback, you allow us to use them without restriction or payment to improve HMind. This does not transfer ownership of map content or confidential material attached to a support request.

Third-party services

HMind interoperates with authentication, storage, app-store, payment and subscription providers. Their services may have separate terms and privacy policies. We are responsible for HMind, but not for an independent provider’s service, decision, outage or content. Mandatory consumer rights remain unaffected.

Suspension and termination

You may stop using connected services or delete your account. We may limit or suspend connected access when reasonably necessary to address a security risk, legal requirement, non-payment or material violation. Where practical, we will provide notice and an opportunity to correct the issue. Account termination does not delete local files on your devices; you remain responsible for them.

Service changes and availability

We work to keep connected services available but do not promise uninterrupted operation. Maintenance, network failures, provider outages, security events and changes in law may affect availability. We may discontinue a connected feature with reasonable notice where practical.

Warranties

To the maximum extent permitted by law, HMind and connected services are provided “as is” and “as available”. We disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. Nothing in these Terms excludes warranties or remedies that cannot legally be excluded.

Limitation of liability

To the maximum extent permitted by law, HMind is not liable for indirect, incidental, special, consequential or punitive loss, or loss of profits, business, goodwill or data, arising from the service. Our aggregate liability for a claim relating to a paid service will not exceed the greater of the amount you paid for HMind during the 12 months before the event giving rise to the claim or USD 50. These limits do not apply where prohibited, or to liability that cannot be limited, including certain consumer rights, fraud, willful misconduct or personal injury.

Disputes and mandatory law

Contact us first so we can try to resolve a concern informally. These Terms do not deprive you of mandatory consumer protections or the right to bring a dispute in a forum available under applicable law. A specific governing-law or arbitration clause does not apply unless separately presented and validly accepted.

Changes to these Terms

We may update these Terms for product, legal or security reasons. We will update the date above and give reasonable notice of material changes. Changes apply prospectively. If you do not agree, stop using connected services before the change takes effect.
